On Thursday, September 13 at 9am, the BART Board of Directors will consider a surveillance technology ordinance that would require transparency, accountability, and oversight for the acquisition and use of everything from license plate readers to drones to social media surveillance. This is the same ordinance that Santa Clara County, Oakland, Davis, and Berkeley have passed.

There are only two remaining areas of disagreement with staff: whether to have an enforceable ordinance with a private right of action and attorney fees (Yes), and whether to allow a trial exception that will allow BART to conduct a 90-day trial in secret (No).
